DMCA & Copyright Policy

Songparts respects the intellectual-property rights of others and responds to notices of alleged copyright infringement consistent with the U.S. Digital Millennium Copyright Act (DMCA) and similar laws.

User-generated content and post-moderation

Substantially all content on Songparts — including MIDI files and their metadata — is user-generated content submitted by our users. We act as a neutral host: we do not create, select, or pre-screen this content, and we are not responsible for it. Instead, we moderate after the fact (post-moderation) — when content is reported or otherwise flagged, we review it and remove anything that should not be here.

As a host, we rely on the safe-harbor protections available to online service providers. We make good-faith efforts to comply with the DMCA and we act on valid takedown requests as soon as we reasonably can.

How to report infringing content

The fastest way: use the “Report” button on the file.

Every version player has a Report / DMCA button. It opens a short online form that ties your notice directly to the specific file, so our moderators know exactly what to review and can act faster. To find a file, browse songs or use search, choose the relevant version, open its player, and click Report.

No postal mail required. Please submit notices through the online form. If you cannot locate the specific file or otherwise cannot use the form, you may email our designated contact at [email protected] with the same information described below. Please include enough detail (especially a direct link) for us to identify the material.

What your notice must include

To be effective, your notice of claimed infringement must include all of the following:

A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Identification of the copyrighted work claimed to have been infringed.
Identification of the material that is claimed to be infringing and that is to be removed, with information reasonably sufficient to let us locate it (for example, the link to the file's page).
Your contact information — name, address, telephone number, and email address.
A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.

The online Report form collects your name and email, identification of the work and the file (use the description field — include direct links), and your good-faith and penalty-of-perjury statement (a required checkbox). If you wish to submit a fully formal notice, you may also include your address, telephone number, and a physical or electronic signature in the description, or send them to the email below. Submitting a knowingly false or bad-faith claim may expose you to liability (see below).

What happens after you report

Reports go into our moderation queue for review — they do not remove anything automatically. We review each report and, where a notice is valid, remove or disable access to the material as soon as we reasonably can. We may notify the user who uploaded the material that it was removed in response to a notice. We document the notices we act on, and a copy of your notice (which may include the contact details you provide) may be forwarded to the affected user and, where appropriate, to others.

Counter-notification

If you uploaded material that was removed and you believe the removal was a mistake or misidentification, you may send a counter-notification to [email protected]. A valid counter-notification must include:

Your physical or electronic signature.
Identification of the material that was removed and the location where it appeared before removal.
A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, the U.S. District Court for the Northern District of California, where Songparts LLC may be found), and that you will accept service of process from the party who filed the original notice (or their agent).

Repeat infringers

In appropriate circumstances we will disable or terminate the accounts of users who are repeat infringers.

Misrepresentations

Under Section 512(f) of the DMCA, anyone who knowingly materially misrepresents that material is infringing — or that it was removed by mistake or misidentification — may be liable for damages, including costs and attorneys' fees. Please make sure your notice or counter-notice is accurate and submitted in good faith.
